PUBLIC OFFER AGREEMENT

for the Provision of Consultation Services and Digital Informational Products
1. General Provisions
This document constitutes a public offer made by Ivan Vladimirovich Bervitskiy, applying the special tax regime “Tax on Professional Income”, hereinafter referred to as the Service Provider, and sets forth the terms and conditions governing the provision of consultation services and access to digital informational products made available on the website jewpercival.com.

Any person who accepts this Offer shall hereinafter be referred to as the Customer.
Acceptance of this Offer shall be deemed to occur upon the Customer taking actions clearly evidencing acceptance of its terms, including payment for a service, product, subscription, tariff, or any other action expressly indicated on the website.

Upon acceptance of this Offer, an agreement between the Service Provider and the Customer shall be deemed concluded on the terms set out herein.

3. Subject Matter of the Offer
The Service Provider shall provide the Customer with consultation services and/or access to digital informational products, including, without limitation:
  • philosophical consultations;
  • individual consultations based on a defined request;
  • support formats;
  • VIP formats;
  • digital materials;
  • access to closed informational spaces, including LIMEN;
  • other products expressly indicated on the website in the form described on the relevant page.
The specific scope, format, timing, price, and content of the relevant product or service shall be determined by the description on the website, in the request form, in correspondence, and/or on the payment page.

4. Nature of Services and Products
The Service Provider’s services and products are consultative, analytical, informational, and authorial in nature. They do not constitute medical, psychotherapeutic, psychiatric, legal, financial, investment, or other licensed professional services.

The Service Provider does not guarantee the occurrence of specific events, the achievement of any particular result, any change in the Customer’s life circumstances, or the receipt of any particular benefit by the Customer.

The Customer’s disagreement with conclusions, interpretations, formulations, philosophical positions, or the nature of the analysis shall not, in itself, constitute improper performance, provided that the service or product has been supplied in the agreed scope and format.

5. Ordering and Performance Procedure
Certain services may require a prior inquiry, completion of a form, clarification of the topic of the request, provision of source data, and subsequent agreement of the terms of interaction.

The Service Provider shall have the right to:
  • accept a request for processing;
  • request additional clarification;
  • propose another format of work;
  • refuse to accept a request without providing reasons where the request does not correspond to the profile of the work, violates acceptable boundaries, shows signs of pressure, manipulation, unlawful purpose, or objectively cannot be properly reviewed.
The provision of the service shall commence after the relevant terms have been agreed and payment has been received, unless otherwise specified separately.

6. Digital Products and Access to LIMEN
Where the Customer purchases access to a digital product, archive of materials, subscription, or closed space, the Service Provider shall grant access in the scope specified in the description of the relevant product.

LIMEN and other closed spaces constitute an informational and analytical product of a general nature and do not create an obligation to provide individual consultation to each participant.

Comments, general replies, individual clarifications, or additional materials, if provided, are ancillary in nature and shall not be deemed a separate consultation service unless expressly stated otherwise by the Service Provider.
7. Price and Payment Procedure
The price of services and products shall be determined by the amount indicated on the website, payment page, current product description, or individually agreed terms. Unless otherwise indicated, payment shall be made on a 100% prepayment basis. The Customer’s payment obligation shall be deemed fulfilled from the moment the funds are received by the Service Provider or by the payment service used.

8. Rights and Obligations of the Customer
The Customer undertakes to:
  • provide accurate information;
  • comply with the terms applicable to the selected product;
  • refrain from using services and materials for unlawful purposes;
  • refrain from infringing the intellectual property rights of the Service Provider;
  • observe an appropriate and respectful format of interaction.
The Customer shall be entitled to receive the paid product or service in the agreed scope and format.

9. Rights and Obligations of the Service Provider
The Service Provider undertakes to provide the paid product or service in the stated or agreed scope.
The Service Provider shall be entitled to determine independently the method, structure, sequence, and language of providing the service within the framework of its authorial approach.

The Service Provider shall also be entitled to update the website, product line, archive, prices, and the content of digital products. Products already paid for shall be governed by the terms in force at the time of payment, unless expressly agreed otherwise.

10. Intellectual Property
All materials provided to the Customer, including texts, documents, schemes, recordings, explanations, methodological formulations, archives, publications, and other elements of the authorial work, shall be objects of the Service Provider’s intellectual property.

The Customer is granted a limited, non-exclusive right to use the materials received for personal purposes only, without the right to publish, distribute, resell, adapt, incorporate into the Customer’s own products, transfer to third parties, or otherwise use them commercially without the prior written consent of the Service Provider.

11. Limitation of Liability
The Service Provider shall not be liable for:
  • decisions and actions of the Customer taken after receipt of the service or product;
  • consequences arising from the use or non-use of the materials;
  • technical failures on the Customer’s side or on third-party platforms;
  • impossibility of performance caused by incomplete or inaccurate data provided by the Customer;
  • the content and operation of third-party services used for payment, communication, storage, or access.
To the fullest extent permitted by applicable law, the Service Provider’s total liability shall be limited to the amount actually paid by the Customer for the specific product or service.

12. Refunds, Cancellations, and Rescheduling
The procedure for refunds, cancellation terms, rescheduling conditions, and the consequences of non-attendance shall be governed by the separate Refund Policy published on the website, which forms an integral part of this Offer.

13. Confidentiality and Personal Data
The processing of personal data and the handling of confidential information shall be governed by the Privacy Policy published on the website.

14. Dispute Resolution
The parties shall seek to resolve any disagreements through negotiations and correspondence.
Claims shall be submitted to info@jewpercival.com.
Failing an amicable settlement, any dispute shall be resolved in accordance with applicable law.

15. Final Provisions
The Service Provider may amend the text of this Offer at any time. A new version shall enter into force from the moment of its publication on the website unless otherwise specified in such version. The relationship between the parties shall be governed by the version of the Offer in force at the time of acceptance.

This Offer is executed in the English language.
